General Data Protection Regulation (GDPR) - Your rights to your data’s access, rectification, erasure, restriction, objection, portability and right not to be subject to automated decision-making/profiling.
By providing your personal and medical information to Monageer Physiotherapy Clinic Ltd, you confirm that;
1) You will advise the clinic of any changes to your details such as: phone number, address, email or medical history and you understand that for GDPR purposes, the clinic must keep your details up to date. You also understand that we keep these details for purposes such as sending appointment reminders or contacting you in emergency situations.
2.1) You understand that the main purpose of collection of your data is for the physiotherapist to consider all of your medical history and to provide you with the most suitable treatment. Please note that if you do not consent to the collection and processing of your personal and health data, we will be unable to provide physiotherapy treatment, as this information is essential for clinical and legal purposes. Under CORU and the Irish Society of Chartered Physiotherapists (ISCP) professional standards, the clinic has a legal obligation to maintain accurate clinical records. If you refuse to let the clinic collect or store your health data, it is impossible to safely assess, treat, or track your medical history and progress. The clinic will have the legal right to refuse treatment, since under GDPR, processing your data is necessary for the provision of healthcare and we cannot legally provide care if we are prohibited from maintaining a record of it.
2.2) You understand that your right to erasure is not absolute as the clinic is required to keep medical data for future legal purposes, should these arise. Under article 17(3) of the GDPR, the right to erasure does not apply to healthcare records if keeping them is necessary for medical diagnosis, the provision of health or social care, or treatment.
3) You are aware that you have the right to request access to your data.
4) You understand that there will be complete confidentiality maintained at all times and that there will be no unauthorised access or sharing of your data.
5) You understand that only staff at Monageer Physiotherapy Clinic Ltd will have access to your data which include: personal details such as phone number, email address, date of birth, address, medical history, and all physiotherapy notes and any imaging reports or consultant letters that were sent to the clinic.
6) You understand that staff at Monageer Physiotherapy Clinic Ltd have undergone provision of training in data protection law and practice.
7) You consent to usage of your data which, if used for research or analysis, will be anonymised and no personal identifiable information will be extracted.
8) You understand that all your data is encrypted and stored on the ‘cloud’ of the Australian based software company Cliniko, which acts as the Data Processor. The data is used by Monageer Physiotherapy Clinic Ltd which acts as the Data Controller.
